Introduction to Constitutional Counties

There is a political struggle going on in America today and the lines are being drawn at the Constitution. From the lack of enforcement of our immigration laws, or gun rights, and the constant overreach of government on the 2nd Amendment, there has been a wayward shift from Constitutional norms in much of today’s governance. 

Previously, we have discussed Constitutional Sheriffs. These are Sheriffs who refuse to enforce unconstitutional legislation and edicts passed by the federal government, state legislators, and local officials. 

Now, we will look at this concept at a broader level as found in the “Constitutional County.”

What is Constitutional County

An organization called The Constitutional County says the following:

Our governments at every level—federal, state, and local—have been corrupted by systemic problems that have ended representative government, leaving us taxation without representation. The Constitutional County provides a blueprint of specific changes to be made to restore our Founders’ progressive visions of world peace through equality and free will, not subjugation.

Constitutional Counties United expands on this language in their definition:

Constitutional Counties United is working to RESTORE Local, County, State & Federal governments by teaching and giving you the tools to form County Assemblies, similar to those formed by early Americans who understood the words of Benjamin Franklin – “It’s a Republic, if you can keep it!”, meaning active involvement by the People is REQUIRED to prevent the plunder of the Nation by special interest groups, corporations and individuals.  

States with Constitutional Counties

One county in New York state recently took up the mantle of this movement when it declared itself a Constitutional County in 2021. The largely conservative Cattaraugus County, consisting of 17 legislators and 8 legislative districts, vowed to end the use of any local resources to infringe upon the constitutional rights of its constituents, reported YourNews.com. The county even updated its mission statement to reflect its commitment.

“If state or federal government continue to overstep their bounds and intrude into the lives of our citizens with unconstitutional mandates, our legislature will step up and challenge that,” said County Legislator, and lawyer, Ginger Schroder following the resolution.

Two counties in Nevada also declared themselves Constitutional Counties in 2021. A resolution approved by both Elko and Lander counties declared that anything which impedes on residents’ constitutionally protected rights will be dealt with as criminal activity, reported The Liberty Roundtable.

The counties’ resolutions explicitly list the unconstitutional activity that will no longer be tolerated:

At the top of the list are orders infringing on the rights to freedom of speech, religion, assembly, and other liberties guaranteed in the U.S. Constitution’s First Amendment.

Other acts that will not be tolerated include efforts to register firearms, gun confiscation, violations of privacy or property rights without a warrant, detainment or arrest without following constitutional procedures, and more.

Role in Preserving American Liberty

The actions of these three counties highlight the increasing resistance to the centralization of federal power and the overreach of state & local governments who disregard our founding documents and inalienable rights. As governments become ever more brazen in their attempts to circumvent the Constitution, are these counties fighting a losing battle, or do they represent the beginning of a national movement to preserve American liberty?
